论人工智能生成物作为孳息的法律属性及权利保护路径

On the Legal Attributes of Artificial Intelligence Products as Fruits and Its Civil Protection

人工智能技术在近年来得到了迅速发展,其在提升劳动便捷度的同时也给当前的法律体系带来了一定冲击。尤其是人工智能生成物当前符合知识产权保护客体的外在表现形式要求,不少学者认为应当对其予以知识产权的保护,引发诸多争论。考虑到知识产权法的价值追求、体系稳定性及其所保护客体的内在要求,应当否定人工智能生成物的知识产权属性,肯定该生成物孳息的法律性质,并搭建起孳息模式下的民事保护模式。

Artificial intelligence technology has developed rapidly in recent years.While improving the convenience of labor,it also has a certain impact on the current legal system.In particular,artificial intelligence products presently align with the ex⁃ternal characteristics of objects protected under intellectual property laws.Consequently,numerous scholars argue that they war⁃rant protection as intellectual property rights,sparking considerable debate.Taking into account the value pursuit of intellectual property law,the stability of the system,and the internal requirements of the objects it protects,this paper proposes denying in⁃tellectual property attributes of artificial intelligence products.Instead,it suggests affirming their legal status as fruits and estab⁃lishing a civil protection framework under the concept of“fruits mode.”
