Carbon emission pledge financing is an important innovation for carbon finance to help achieve the goal of carbon peak and carbon neutral.At present,although carbon emission pledge financing has been successfully implemented in some places,there are still great legal risks in practice.In terms of legitimacy,there is a lack of clear and unified legislative support for carbon emission right pledge financing;in terms of implementation mechanism,there are problems of fewer participating institutions,chaotic registration system,insufficient realization of quality rights and vulnerable to policy influence;in terms of regulatory system,there are high demand for authenticity and veriability of carbon emission indicators,incomplete risk assessment system,inadequate guarantee of solvency,and insufficient regulatory capacity of regulatory agencies.In order to further promote the effective development of carbon emission right pledge financing business,the relevant laws and regulations of carbon emission right pledge financing should be improved,the implementation mechanism of carbon emission right pledge financing should be improved,and the supervision system of carbon emission right pledge financing should be improved,so as to break the legal risks of carbon emission right pledge financing.
