在监察体制改革中,公安机关协助监察机关是一个重要课题。准确把握监警协助行为的性质,有助于构建科学的监警协助机制。当前,关于监警协助行为的性质存在监察行为说、行政协助行为说、刑事司法协助行为说等多种观点。监警协助行为性质纷争的原因主要包括监警双方权力构成多元、协助事项范围模糊等。通过分析监警协助行为性质的不同观点和监警行为的模式,可以发现监警协助行为是一种特殊行为,是为保证办案效率和公正的动态行为,它在特定条件下既可表现为监察行为、行政协助行为,也可表现为监察与行政兼具等行为。

In the reform of supervision system,it is an important subject for the public security organs to assist the supervisory organs.Accurately grasping the nature of police supervision assistance behavior is helpful to build a scientific police supervision assistance mechanism.At present,there are many views about the nature of supervision and police assistance behavior,such as supervision behavior,administrative assistance behavior,and the dual attribute of administrative assistance and criminal justice.The reasons for the disputes of the nature of supervision and police assistance mainly include the plural composition of the powers of both supervisors and police,the vague scope of assistance,etc.By analyzing the different views on the nature of the police supervisor’s assistance behavior and the mode of the police supervisor’s assistance behavior,we can find that the police supervisor’s assistance behavior is a special behavior,a dynamic behavior to ensure the efficiency and justice of handling cases,and it can be manifested as both supervision behavior,administrative assistance behavior,and supervision and administration behavior under specific conditions.
