我国家庭教育地方立法的特征、问题与展望——基于12份省级行政区家庭教育促进条例文本的分析

摘要 家庭教育作为个体成人的基础,其水平直接关系到下一代的健康成长、千家万户的福祉与国家民族的未来。本研究通过内容分析法对12份省级行政区家庭教育促进条例的文本结构、目标、各主体责任以及法律责任进行分析,发现各省条例呈现出结合实际情况、体现地方智慧、强调促进功能、突出惩戒弱化、整体设计规范、内容较为全面的特征,其中也存在着表述有待明确、机制有待健全的问题。本研究认为,新时代家庭教育促进条例的修改与制定应朝向明确权责划分、健全保障机制、总结地方经验的方向发展。 As the foundation for an individual's adulthood,the level of family education is directly related to the healthy growth of the next generation,the well-being of thousands of families,and the future of the nation.Using the Content Analysis Method,this study analyzed the textual structure,objectives,responsibilities and legal liabilities of 12 provincial regulations on the promotion of family education.The provincial regulations were found to exhibit a standardization in overall design,comprehensive content,emphasis on the function of promotion,lessening of punishment,consideration of the on-ground situation,and use of the wisdom of the local community.The regulations were also found have some problems that need to be addressed,namely clarity of communication and thoroughness of mechanisms for implementation.This study concludes that the revision and formulation of the regulations on the promotion of family education in the new era should be directed towards clarifying the division of powers and responsibilities,improving the safeguard mechanism,and consolidating the experiences of different locales.
