Study on the restorative judicial application in forest-related crimes

本文主要在恢复性司法的视野下,根据近年来生态实践中“复植补绿”的做法,通过规范研究、比较研究等方法研究盗伐、滥伐林木犯罪适用恢复性司法在实践中出现的问题,发现适用中存在对恢复性司法认识不足和法律制度不健全的困境,对于涉林类犯罪案件中适用恢复性司法理念给予肯定,提出通过立法将恢复性司法措施作为一种非刑罚处罚方式在量刑时予以考量,明晰恢复性司法程序与普通程序的关系,同时规范恢复性措施的标准和监督确保在实践中准确适用。

This paper,from the perspective of restorative justice,investigates the application of restorative justice in cases of illegal logging and deforestation,based on the recent ecological practice of"replanting and green restoration."Through normative and comparative research methods,it identifies the problems encountered in the practical application of restorative justice,including inadequate understanding of restorative justice and the lack of sound legal systems.Affirming the application of restorative justice principles in forestry-related crime cases,it proposes the consideration of restorative justice measures as a non-criminal punishment in sentencing through legislation,clarification of the relationship between restorative justice procedures and ordinary procedures,and standardization of restorative measures to ensure accurate application in practice.
