摘要
应急行政权植根于紧急权,在理论上划定两者之间的界限几乎无法实现。在西方法学学术史视域下,紧急权对应于“例外状态”,属于政治法意义上的事实问题和主权问题,司法审查不得介入;应急行政权属于应用法范畴,对应于突发性事件。司法规制应急行政权的广度与强度极为有限,且其价值不在于约束应急行政权,而在于救济不合理克减的公民权利。应急行政权司法规制的边界为越权审查,即合法性审查。
The emergency administrative power roots in emergency power,and it is almost impossible to delineate their boundary in theory.Emergency power corresponds to the"exceptional state",which is a matter of fact and sovereignty in the sense of political science,and judicial review shall not be involved.The emergency administrative power corresponds to emergencies.The breadth and intensity of judicial regulation on the emergency administrative power are limited,and its value is not only to restrain the emergency administrative power but also to relieve the civil rights unreasonably derogated.The boundary of emergency administrative power judicial regulation is excessive review,namely legitimacy review.
