“双碳”目标下我国编纂环境法典的法治需求与制度回应

Law Demands and Institutional Response to the Codification of the Environmental Code Under the“Dual Carbon”Goal

基于环境法视域检视,当前我国在保障“双碳”目标法律建设方面存在专门性法律缺失、相关法律规范协同不足和配套政策手段不够等问题。可借鉴应对气候变化制定专门法律规范、编撰环境法典规定相关制度应对气候变化和在立法中强调能源效率的突出地位等域外经验,对“双碳”目标融入我国未来环境法典做出法技术安排:(一)理念目标上以可持续发展理念衔接“双碳”目标价值;(二)体系结构上实现环境法典与单行法、政策的互为补充;(三)核心内容上将“双碳”因素纳入环境评价与行政许可。

Based on the review from the perspective of environmental law,there are problems such as the lack of special laws,insufficient synergy of relevant legal norms and insufficient supporting policy guarantee means in China’s current legal construction to guarantee the“dual carbon”goal.Based on the experience of foreign countries such as the formulation of special legal norms,codification of the environment code and regulations to cope with climate change,emphasis of the prominence of energy efficiency in legislation,we can make the following legal technical arrangements to integrate the“dual carbon”goal into China’s future environmental code:(1)using sustainable development to link the value of“dual carbon”goal in conceptual objectives;(2)making the environmental code,the slip laws and policies complement each other in system structure;(3)incorporating the“dual carbon”factors into the environmental evaluation and administrative permit in the core content.
