社会治理法学博士点设置的基础、现状及问题分析

Analysis of the Foundation,Status Quo and Problems of the Establishment of Doctorate Programs in Social Governance Jurisprudence

社会治理法学作为一门新兴交叉学科,在我国起步较晚,其理论基础广泛分布于法学、公共管理学、社会学等领域,本文以徐汉明教授关于社会治理法学研究对象的理论为依托,首先对社会治理法学学科设置的必要性、可行性进行研究。在此基础上对中南财经政法大学、西北政法大学两所学校的社会治理法学博士点设置、博士生招生、培养情况进行分析,发现当前社会治理法学设置总量、招生人数极少,在博士生培养上重视培养博士生的实证研究能力与跨学科研究能力。但是,当今社会治理法学在学科设置上依然存在整合难度较大、定位不清晰、理论与实践相脱节等问题。针对以上问题,提出了鼓励有条件的高校设置社会治理法学博士点,推动社会治理法学相关学科整合,探索社会治理法学研究新方向三点建议。

As an emerging interdisciplinary discipline,social governance jurisprudence started late in China,and its theoretical basis is widely distributed in the fields of law,public administration,sociology,and so on.Based on Professor Xu Hanming’s theory on the research objects of social governance jurisprudence,this paper first analyzes the necessity and feasibility of setting up a discipline of social governance jurisprudence.On this basis,we analyze the setting of social governance jurisprudence doctoral programs and the enrollment and cultivation of doctoral students at the Central South University of Finance and Law and the Northwest University of Political Science and Law,as well as the recruitment and cultivation of doctoral students.Research was conducted using the method of literature analysis.It was found that the current total number of social governance jurisprudence programs and enrollment are very small,and emphasis was placed on cultivating doctoral studentsempirical research ability and interdisciplinary research ability.However,there are still many problems in the establishment of social governance jurisprudence,such as the difficulty in integration,unclear positioning,and the disconnection between theory and practice.
