CPTPP数字贸易规则的内容特征及中国应对策略

Content Characteristics of CPTPP Digital Trade Rules and China's Countermeasures

当前国际贸易规则正处于重构期,数字贸易规则的制定是关键一环。各大经济体谋求在数字贸易规则制定层面掌握主动权,从而在新一阶段世界贸易发展竞争中赢得先机。《全面与进步跨太平洋伙伴关系协定》(CPTPP)关于数字贸易的相关规则作为亚太地区高标准、高水平的代表,势必会对中国数字贸易的发展产生一定影响和挑战。CPTPP数字贸易规则包括消除数字贸易壁垒、数字贸易便利化、网络安全和数据安全、跨境数据流动4个方面重要内容,具有深化传统议题、引入争议性议题、预留迂回空间3个方面主要特征。对此,中国要从加快数字贸易法律体系建设、积极参与国际贸易规则制定、掌握规则制定主动权等方面做出应对方案。

At present,international trade rules are in a period of restructuring,among which the key part is digital trade rules.Major economies are seeking to take the initiative in the formulation of digital trade rules,so as to win the opportunity in the new stage of the competition for the development of world trade.As a representative of high standard and high level of the digital trade rules in Asian-Pacific region,the Comprehensive and Progressive Trans-Pacific Partnership(CPTPP)are bound to have a certain impact and challenge to the development of China's digital trade rules.CPTPP digital trade rules include four important aspects:eliminating digital trade barriers,digital trade facilitation,network security and data security,and cross-border data flow.They have three main characteristics:deepening traditional issues,introducing controversial issues,and reserving roundabout space.In this regard,China should accelerate the construction of digital trade legal system,actively participate in the formulation of international trade rules,and take the initiative in rule-making.
