互联网背景下的同人作品侵权及著作权保护问题

摘要 随着互联网的普及和发展,同人作品突破了圈子的限制而得以广泛传播,受众群体也逐渐扩大,随之而来的是同人作品创作者和互联网平台、网络出版商之间可能产生的一系列的纠纷。人物角色是文学作品的核心和灵魂,人物角色著作权保护既符合现实需要又符合法律要求。为给予人物角色充分保护,我国应当尽早实现人物角色著作权保护,确定保护标准和侵权认定标准。著作权通常是对作品整体进行保护,但由于文学作品人物角色具有高度抽象性,其著作权保护标准难以统一。文章通过分析域外法保护文学作品人物角色的方法,发现故事被叙述法具有可借鉴性,并在此基础上总结出适合我国的文学作品人物角色著作权保护标准:文学作品人物角色具有独创性,且这种独创性能够使大多数读者辨别其来源,而对独创性的判断依据应是作品具体情节,而非作品整体。 With the ubiquitous of the Internet,fan works have broken through the restrictions of the circle and been widely spread,and their audience has gradually expanded,followed by a series of disputes that may arise between the creators of fan works,the platform and publishers.Character is the core and soul of literary works,and the protection of character copyright is in line with both practical needs and legal requirements.In order to provide sufficient protection,China should implement copyright system for characters as soon as possible,and establish infringement determination standards.Copyright usually protects the work as a whole,but due to the highly abstract nature of characters,the standards for copyright protection are difficult to unify.Thus,drawing on the experience of extra-territorial laws,it’s found that the storytelling method has reference value.Based on this,the feasible copyright standards for literary characters is pointed out:literary characters have originality,and it is this originality that enable readers to identify their sources.The judgment of originality should be based on specific plot,rather than the work as a whole.
