民事检察精准监督制度探究——以民事虚假诉讼为切入点

随着经济生活的飞速发展,虚假诉讼案件数量持续攀升,该类案件不仅损害了国家利益、公共利益及他人的合法利益,更损害了司法权威和司法公信力。近年来,检察机关在虚假诉讼的预防、甄别和查处方面都取得了一定的进展,但在具体办案过程中仍然面临着案件发现难、查证难、监督难的一系列难题。检察机关应当不断探索矛盾纠纷多元化解路径,以精准监督为指引,不断完善精准化监督制度,有效提升检察监督精准度,有力打击虚假诉讼案的发生,为平安建设和矛盾纠纷化解提供法治保障。

With the rapid development of economic life,the number of false litigation cases continues to rise,which not only damages the legitimate interests of the state and public interests and rights holders,but also damages the judicial authority and credibility.In recent years,the procuratorial organs have made some progress in the prevention,screening and investigation of false litigation,but in the specific process of handling cases,they still face a series of difficulties in case discovery,verification and supervision.Procuratorial organs should constantly explore multiple ways to resolve contradictions and disputes,take precise supervision as a guide,constantly improve the precise supervision system,effectively improve the accuracy of procuratorial supervision,effectively crack down on the happening of false lawsuits,and provide legal protection for the construction of peace and the resolution of contradictions and disputes.
