刑事司法改革背景下认罪认罚从宽制度中监察与司法衔接问题研究

Research on the Coherence Between Supervision and Justice in the System of Plead Guilty to a Lenient Punishment under the Background of Criminal Justice Reform

《中华人民共和国监察法》第31条规定监察机关可以提出认罪认罚从宽建议,然而监察机关从宽处罚建议在嵌入认罪认罚从宽制度时遇到了一定障碍。认罪认罚从宽制度在职务犯罪案件中的适用与在非职务犯罪案件中的适用相比,在标准、程序以及效力等方面都存在较大差别。这与监察工作与司法工作在价值逻辑、权力结构、制度机制等方面的差异是分不开的。为解决职务犯罪案件认罪认罚从宽制度中监察与司法衔接问题,应当从协调监察制度的价值以及认罪认罚从宽制度的价值,妥善处理监察机关与检察院、法院之间配合和制约关系以及完善监察调查阶段适用认罪认罚从宽的相关配套制度等角度开展工作。

Article 31 of the Supervision Law stipulates that the supervisory organs can propose leniency of guilty plea,but the leniency of supervisory organs has encountered some obstacles when it is embedded in the leniency of guilty plea system.Compared with non-duty crime cases,the leniency system of guilty plea in duty crime cases has great differences in starting standard,application procedure and implementation effect.This is inseparable from the differences between supervision and judicial work in value logic,power structure,system mechanism and so on.In order to solve the problem of the connection between supervision and justice in the system of leniency of guilty plea in duty crime cases,the work should be carried out from the perspectives of coordinating the value of supervision system and the value of leniency of guilty plea system,properly dealing with the cooperation and restricting relationship between supervisory organs,procuratorates and courts,and perfecting the relevant supporting system of applying leniency of guilty plea in the stage of supervision and investigation.
