气候变化视角下生物多样性保护法律问题研究

Study on Legal Issues of Biodiversity Conservation from the Perspective of Climate Change

如何应对气候变化对我国生物多样性带来的不利影响,是生物多样性保护法治建设必须面对的问题。目前,我国生物多样性保护相关法律法规缺乏应对气候变化的针对性规定,相关法律在指导思想、立法目的、管理体制、运行机制、制度构建等方面存在不足。为此,建议加强生物多样性保护的顶层设计,完善生物多样性保护工作运行机制,鼓励多元主体协同参与治理,构建科学严谨的生物多样性调查制度,建立兼顾应对气候变化和生物多样性保护的自然保护地法律体系,为生物多样性保护提供可行路径。

How to cope with the adverse effects of climate change on China’s biodiversity is a problem that must be faced in the construction of the rule of law on biodiversity protection.At present,China’s laws and regulations related to biodiversity conservation lack targeted provisions to address climate change.There are deficiencies in the guiding ideology,legislative purpose,management system,operational mechanism and institutional structure of the relevant laws.In this regard,it is recommended to strengthen the top-level design of biodiversity conservation,improve the reasonable operational mechanism for biodiversity conservation,encourage the concerted participation of multiple actors in governance,establish a biodiversity survey system that can provide a basic scientific basis for biodiversity conservation,and establish a legal system for nature reserves that takes into account climate change,in order to provide a feasible path for biodiversity conservation so as to provide a feasible path for biodiversity conservation.
