检察介入监察呈现相互区别又层叠并进的三重样态。检察个案型介入监察是检察介入监察的基础,检察预防型介入监察是检察介入监察的依托,检察发展型介入监察是检察介入监察的目标。检察个案型介入监察既要区分案件类型,明确介入部门与范围,又要加强办案人员能力与道德建设,还要实现介入内容的多样化、系统化。检察预防型介入监察应找准介入的点、线、面,从案件移送、接收、审查、处理过程中证据与证明标准、案件事实认定、法律适用等方面入手,在纵、横两个角度搭建介入平台,拓展介入领域。检察发展型介入监察应加强检察介入监察的配套机制建设,营造廉政文化氛围,培养“公正优先、兼顾效益”的价值观,促进和保障检察介入监察功能的全面实现。

Procuratorial intervention in supervision presents a triple mode that is distinguishable,layered,and progressive.The single-case intervention is the foundation,preventive intervention is the reliance,and developmental intervention is the goal of procuratorial intervention in supervision.In the single-case intervention,the procuratorial organs should not only differentiate between case types and clarify the intervening departments and scope,but also strengthen the capacity and ethical construction of case-handling personnel and achieve diversified and systematic intervention content.In preventive intervention,procuratorial organs should identify the points,lines and surfaces of intervention,starting from the evidence and the standard of proof,the determination of the facts of the case,the application of the law and other aspects in the process of case transfer,reception,review and handling,and build a platform for intervention from both vertical and horizontal perspectives to expand the field of intervention.In developmental intervention,procuratorial organs should strengthen the construction of supporting mechanisms for procuratorial intervention in supervision,create a culture of integrity,cultivate a value of"giving priority to justice with full consideration to efficiency"and promote and guarantee the comprehensive realization of the function of procuratorial intervention in supervision.
