地方法中守信激励机制的归纳与检讨

The Induction and Review of the Trustworthy Incentive Mechanism in the Local Law

当前地方立法中的守信激励机制出现了激励措施与现有奖励措施相似、重失信惩戒轻守信激励、守信激励判断标准不一、评价内容扩大化等问题。这些问题的产生与守信激励机制边界模糊、重惩戒轻奖励的传统习惯、信用制度的服务对象扩大、信用评价依据多样化等因素密切相关。据此,提出明晰制度边界、限制信用评价内容、制定国家层面的判断标准以及适当减轻政府负担的优化建议,以期为地方的进一步探索乃至国家层面的立法提供支撑。

The current credit incentive mechanism in local legislation has encountered problems such as similar incentive measures to existing reward measures,heavy punishment for dishonesty over credit incentives,inconsistent judgment standards for credit incentives,and expanded evaluation content.These problems are closely related to factors such as the blurred boundaries of the credit incentive mechanism,the traditional mindset of heavy punishment and light reward,the expansion of the service target of the credit system,and the diversification of credit evaluation criteria.Based on this,we propose clarifying institutional boundaries,limiting the content of credit evaluation,establishing national-level judgment standards,and appropriately reducing the government's burden,so as to provide support for further local exploration and even national-level legislation.
