空间治理视角下国土空间规划与用途管制衔接制度研究

Research on the Connection System of Territorial Spatial Planning and Use Control from the Perspective of Spatial Governance

从国土空间治理视角阐述国土空间规划与用途管制衔接的内涵,明晰用途管制改革的出发点和着力点,并从规划编制、审批、实施、监督全生命周期管理各环节分析二者衔接存在的问题和解决的策略。从治理内容、时序、权限、效率等方面实现二者全面对接,能提高规划实施的针对性和实用性以及用途管制的效率和效用。衔接过程中应致力于从制度设计上化解存在的问题并避免出现误区,探索构建以共同发力的协调制度、全面衔接的传导制度、权责对等的事权制度、紧密关联的监督制度为重点的衔接制度体系,可实现国土空间规划与用途管制的无缝衔接。从国土空间治理需求出发,在空间体系、传导机制、事权层级、实施监督等方面充分衔接,通过出台相关政策法规、完善技术标准、建立联动机制,为二者衔接提供保障,有助于提升国土空间治理水平。

Based on the perspective of territorial spatial governance,we elaborated on the connotation of connection between territorial spatial planning and use control,clarified the starting point and focus of use control reform,and analyzed the problems and solutions of connection between the two from various aspects of planning preparation,approval,implementation and supervision throughout the entire lifecycle manage-ment.We found that achieving comprehensive integration between the two in terms of governance content,governance timing,governance authority,governance efficiency could improve the pertinence and practicality of planning and implementation,and the efficiency and effectiveness of use control.In the connection process of them,efforts should be made to resolve existing problems and avoid misunderstandings from the perspective of institutional design.Exploring the construction of a coordinated system with joint efforts,a comprehensive transmission system,a system of equal rights and responsibilities,and a closely related supervision system can achieve seamless connection between territorial spatial planning and land use control.Starting from the needs of territorial spatial governance,it is necessary to fully connect the spatial system,transmission mechanism,authority hierarchy and implementation supervision.By introducing relevant policies and regulations,improving technical standards,and establishing linkage mechanisms,it provides guarantees for the connection between the two,which helps to improve the level of territorial spatial governance.
