发挥专利在太湖区域环境保护中促进作用的进路选择

Choosing Pathways to Harness the Promotional Role of Patents in Taihu Lake Regional Environmental Protection

以专利为代表的技术性知识产权通过强化“技术要素”的作用,并经由环境监测、污染治理、资源利用等环节,对促进环境保护起到积极作用。目前,我国还存在海量技术性知识产权未能得到有效利用、既有制度空间未得到充分利用、基础性制度存在缺失等问题。通过“项目先导、区域试点、法律跟进”具体路径,于太湖这一世界级湖区进行区域试点,并在整体过程中注意偏离效应,可以逐步实现良法善治。

By strengthening the role of“technical elements,”represented by patents,and through processes such as environmental monitoring,pollution control,and resource utilization,technological intellectual property rights play a positive role in promoting environmental protection.At present,there are still problems such as the ineffective utilization of a massive amount of technological intellectual property rights,underutilization of existing institutional space,and deficiencies in foundational institutions.Through the specific path of“project-led,regional pilot,and legal follow-up”,we can gradually realize good law and good governance by conducting regional pilot projects in the Taihu Lake,a world-class lake area,and paying attention to the deviation effect in the overall process.
