Study on Courtroom Language from the Perspective of Legal Anthropology

从不同角度对法庭语言的研究进行梳理,并运用法人类学领域的先行研究得出的概念和类型作为主要框架对法庭语言进行分析。通过考察审判的主要参与者之间的互动和交流,来证实其主张在传达方式和形式上具有规律性,并会影响主张的说服力和可信度。研究发现,审判参与者之间存在着发言顺序、叙述逻辑的差异,根据研究发现,这种差异在一定程度上对审判结果产生影响。

This paper examines research on courtroom language from various perspectives and utilizes concepts and classifications derived from previous studies in the field of legal anthropology as a primary framework for analyzing courtroom language.By investigating the interaction and communication among key participants in trials,it is demonstrated that their arguments follow certain patterns in terms of communication style and format,which significantly impact the persuasiveness and credibility of these claims.Differences are observed in speech order and narrative logic among trial participants.Findings that suggest such variations have some influence on trial outcomes.
