社会主义核心价值观融入医疗损害责任裁判的实践样态及优化路径——以37份医疗损害责任裁判文书为分析样本

Practice Patterns and Optimization Paths of the Integration of Core Socialist Values into Medical Liability Judgement——37 Judgment Documents of Medical Liability as Analysis Sample

社会主义核心价值观融入医疗损害责任裁判文书,对保障患者合法权益、提升医疗质量、回应社会对健康公平的期待具有重大意义。笔者对中国裁判文书网2019-2023年的37份医疗损害责任裁判文书中社会主义核心价值观的融入情况进行了实证分析,发现其在增强判决文书的说服力方面产生了较好效果,但也存在融合程度不够、援引较为被动等缺陷。因此,我们应继续深化社会主义核心价值观在医疗损害责任裁判文书中的融入,增强其有机性和合理性,让司法裁判更好地贯彻和弘扬社会主义核心价值观,构筑优质的社会公正防线。

The integration of core socialist values into medical liability judgement documents is of great significance in safeguarding the legitimate rights and interests of patients,improving the quality of medical care,and responding to the social expectations of health equity.After an empirical analysis of the integration of core socialist values in 37 medical liability judgments from 2019-2023 on the China Judgment Website,it is found that it has produced a better effect in enhancing the persuasive power of the judgement documents,but there are also shortcomings such as insufficient degree of integration and more passive invocation.In the future,we should continue to deepen the organicity and reasonableness of the integration of core socialist values in medical liability judgements,so that judicial decisions can better carry out and promote core socialist values,and build a high-quality social justice defence.
