我国环境保护公众参与的问题及其修正

Problems of Public Participation in Environmental Protection in China and Their Solutions

良好的环境状况是人们健康生存与发展的前提条件,它维系着人们的切身利益。引入环境保护公众参与机制是解决环境问题的必要条件,也是当今国际形势发展的主流。我国的工业化起步晚,环境法律法规政策还处在发展阶段,有待进一步成熟;我国现有的环境保护公众参与制度存在着相关规定较为抽象、操作性欠强、信息公开有待完善、参与主体范围较狭窄、权利救济实效性较弱等不足之处,出现此类问题的原因是多方面的,在当前形势下应当完善该制度,找到新的路径来解决中国环境保护的公众有序参与问题。

Good environment is the development premise condition,which involves the vital interests of the majority.Therefore,theintroduction of environmental public participation mechanism is the necessary condition of the solution of the problemof environment,as well as the mainstream of the development of the international situation today.But,for the industrialization in China started late,theenvironmental laws and regulations policy is still in its initial stage of immature public participation system.There are problems suchasabstract regulations with weak operability,imperfect information disclosure,the narrow participation subject scope.In this paper,basedon the existing problems of public participation the reasons are analyzed so as to seek the sultions.
