The Specialization of the Procuratorial Work on Intellectual Property:Realistic Difficulties and Governance's Improvement

知识产权检察专门化,既是创新知识产权检察履职模式的应有之义,又是建构中国自主知识产权保护体系的战略之举。从试点情况来看,制度供给不足、民行检察案件“成案难”、人才建设与专业能力不匹配等问题,已成为制约知识产权检察专门化的瓶颈。为此,有必要从以下三个方面发力,以提升知识产权综合检察治理质效,助推中国知识产权保护现代化的实现:一是完善知识产权诉讼程序立法,建议增设知识产权民事公益诉讼、行政公益诉讼和支持起诉制度。二是优化知识产权检察专门化运行机制,包括统一知识产权综合检察的规范适用尺度,加大知识产权案件办理的检察监督力度,加强知识产权案件当事人合法权益的保护强度。三是创新知识产权检察专门化的治理能力建设,包括厘清知识产权检察专门化的组织定位、加强知识产权检察专门化的理论研究、做强知识产权检察专门化的外脑智库。

The specialization of procuratorial work on intellectual property innovatively complies with the connotative meaning of the performing mode of procuratorial power,also is a strategic measure of promoting the comprehensive supporting reforms of the judicial system.From the perspective of the pilot performances,the deficiency of the institution,the“dificulty of establishing cases”in civil-administrative procuratorial work,and the imbalance between talent construction and professional capabilities have become the bottleneck of constructing the specialization of procuratorial work on intellectual property.The following there pillars shall be highlighted in order to further improve the quality and efficiency of the comprehensive procuratorial governance on intellectual property,and to promote the realization of the modernization of China's intellectual-property protection and the powerful-state strategy in intellectual property:The first is to improve the procedural legislation for intellectual property litigation,with the advice of newly establishing civil-public-interest and administrative-public-interest litigation of intellectual property,and supportive prosecutorial institutions.The second is to improve the function mechanism of procuratorial specialization on intellectual property,including the unification of the normative application standards in the comprehensive procuratorial work on intellectual property,enhancing the supervision intensity for intellectual-property cases,and enhancing the protection intensity for the legitimate right of parties in intellectual-property cases.The third is to innovate the governance-capability construction in the specialization of procuratorial work in intellectual property,including clarifying the organizational orientation,enhancing theoretical researches,and strengthening the exterior think tank of the specialization of procuratorial work on intellectual property.
