剧本杀作品的著作权规制问题研究

Research on the Copyright Regulation of Script Murder Works

剧本杀这一现象级娱乐项目带来了一些著作权法上的难题,实质上反映了目前著作权法制度层面的相关争议。剧本杀整体可以构成作品,但玩家按照游戏规则进行游戏的部分并非演绎文字作品,所以笔者认为在现存法律规定的框架内剧本杀被认定为其他作品或者通过各个组成部分单独保护较为适宜,出租盗版剧本的行为目前只能通过他项权进行控制,而表演剧本的行为只能规制经营者而不能使消费者承担责任。

Script murder,a phenomenal entertainment project,has brought some problems in copyright law,which essentially reflects the controversy at the level of copyright law system.The scripts of script murder can be recognized as a work,but the part of the game played by players according to the rules of the game is not a derivative literary work.So it is more appropriate to identify script murders as other works within the framework of existing legal provisions or to protect them individually by each component.At present,the act of renting out pirated scripts can only be controlled through encumbrance right,and the act of performing scripts can only regulate the operators but not the consumers.
