摘要
家务劳动补偿制度是立法机关为消除女性在家庭内部长期受到的劳动剥削,基于权利和义务对等原则作出的制度创新。家务劳动的分担不只是生产力发展水平问题,更是一个暗含公平与正义等基本价值的重大性别问题。法律对劳动性别分工的纠正,肯定了家务劳动的经济价值,有益于提升女性在家庭以及社会中的地位。《民法典》对家务劳动补偿制度作出了修改和完善,但实践中也存在某些不足。通过对实践中存在的问题进行分析,并提出具体的改进措施,希望能够改善我国家务劳动补偿制度的实用价值。
The domestic labor compensation system is an institutional innovation made by the legislature to eliminate the long-term labor exploitation of women within the family based on the principle of reciprocity of rights and obligations.The sharing of housework is not only a matter of productivity development level,but also a major gender issue that implies basic values such as fairness and justice.The correction of the gender division of labor by law affirms the economic value of housework and is beneficial to enhance the sta-tus of women in the family and society.The“Civil Code”has revised and improved the housework compensation system,but there are also some shortcomings in the event.To adjust the exercise time of rights,set scien-tific measurement methods,and clarify the form of compensation as the entry point,find ways to alleviate,or make up for it.
