摘要
随着公司律师制度的顺利推行,公司律师执业人数逐步增加,公司律师队伍已经成为企业风险防控、法治文化宣传贯彻的重要力量。公司律师需要综合运用法律思维、商业思维,深度参与企业经营管理,承担企业参谋助手角色。公司律师执业中存在的问题是,虽受多方管理,但未形成统一的考评机制,工作成效不明显,执业影响力有待提升。完善公司律师管理机制、提升公司律师执业效能,建议从优化公司律师管理方式、提高公司律师业务素质着手,全面提高企业风控能力,加快推动中国特色社会主义法治建设。
With the successful implementation of the corporate lawyer system,the number of corporate lawyers in practice has been rising,and the team of corporate lawyers has become an important force in the prevention and control of corporate risks and the propagation and implementation of the culture of the rule of law.Corporate lawyers need to comprehensively use legal thinking,business thinking,in-depth participation in business management,to assume the role of corporate consultant and assistant.The problems in the practice of corporate lawyers are that,although they are subject to multi-party management,they have not formed a unified evaluation mechanism,their work is not effective and the impact of their practice needs to be enhanced.To improve the management mechanism of corporate lawyers and enhance their practice efficiency,it is proposed to optimize the management style of corporate lawyers and strengthen the business quality of corporate lawyers,so as to comprehensively improve the ability of enterprises to control risks and accelerate the promotion of the construction of the rule of law of socialism with Chinese characteristics.
