Issues on Legal System in Consolidating a Strong Sense of Community for the Chinese Nation

铸牢中华民族共同体意识是新时代党的民族工作的主线和“纲”,同时也是一个基于法律治理的系统性工程。铸牢中华民族共同体意识工程涉及宣示性法律、实施性法律、权益保障性法律以及捍卫性法律等四类。前三类法律侧重于正向引导、鼓励、保障(证)有利于铸牢中华民族共同体意识的行为;捍卫性法律则是通过防范和惩处危害中华民族共同体的具体行为,从制止反向发展的角度保障铸牢中华民族共同体意识事业的正常发展。从铸牢国家共同体意识的国际比较视域来看,中国铸牢国族的伟大实践建立在系统的、有坚实社会正义支撑的法律体系之上,西方国家包括部分发展中国家则存在着程度不同的问题或不足。

Consolidating a strong sense of community for the Chinese nation is the main task of the Party's ethnic work in the new era and also a systematic project based on legal governance.The project of consolidating a strong sense of community for the Chinese nation involves four types of laws:declaratory laws,implementing laws,rights protection laws,and defending laws.The first three types of laws focus on positively guiding,encouraging,and guaranteeing behaviors that are conducive to consolidating a strong sense of community for the Chinese nation;defensive laws aim to prevent and punish behaviors that harm the community of the Chinese nation,ensuring the normal development of the cause of consolidating a strong sense of community for the Chinese nation from the perspective of stopping reverse development.From the international comparative perspective of consolidating a strong sense of community for the Chinese nation,China's great practice of consolidating the nation is built on a systematic and legally sound social justice supporting legal system,while Western countries,including some developing countries,have various problems or deficiencies.
