摘要
本研究以StarLink Corn事件为案例,探讨了遗传改良作物在法律和监管方面面临的挑战。StarLink Corn是由Aventis CropScience开发的一种转基因玉米,含有一种来自土壤芽孢杆菌的蛋白质Cry9C,旨在抵抗某些害虫。尽管仅获批用于动物饲料,但该产品意外进入了人类食品供应链,引发了广泛关注和法律诉讼。本研究分析了事件对农业产业、消费者信心和国际贸易的影响,强调了在食品安全和环境保护方面需要更加严格和全面的法律框架。同时,提出了对风险管理、公众接受度、国际法律框架和新兴生物技术法律挑战的进一步研究建议。本案例为未来遗传改良作物的法律和政策发展提供了重要的指导和教训。
This study takes the StarLink Corn incident as a case to explore the legal and regulatory challenges faced by genetically modified crops.Developed by Aventis CropScience,StarLink Corn is a type of transgenic maize containing Cry9C,a protein from the soil bacterium Bacillus thuringiensis,designed to resist certain pests.Although it was only approved for animal feed,the product inadvertently entered the human food supply chain,leading to widespread concern and legal litigation.This research analyzes the incident's impact on the agricultural industry,consumer confidence,and international trade,highlighting the need for stricter and more comprehensive legal frameworks in food safety and environmental protection.It also proposes further research on risk management,public acceptance,international legal frameworks,and legal challenges in emerging biotechnologies.This case provides important guidance and lessons for the legal and policy development of future genetically modified crops.
