Procedural Jurisdiction and Optimization in the Investigation and Handling of Duty Crime Cases

职务犯罪案件查处中的程序管辖涉及对内与对外两个层面:对内性程序管辖以监察调查自身及其上下级关系为主;对外性程序管辖以监察机关与公安机关、检察机关的衔接协调为主。监察调查程序管辖以实体管辖为起点,以职务违法与职务犯罪的一体化调查为前提,并要遵循监察调查的法治化运行。现有规范制度对外分工视域的职能管辖规则优化,包括了单向线索移送向双向线索移送规则的转化、监察机关与检察机关管辖权的竞合情形、监察机关与公安机关互涉案件中的相互协作。除此之外,现有对内分工视角的调查管辖规则进行了细化完善,包括对级别管辖与地域管辖的规则调整、提级管辖与指定管辖的制度落实等。职务犯罪案件查处中的程序管辖规则有进一步优化的空间,具体涉及对现有规则中互涉案件程序管辖的语词廓清、互涉案件程序管辖优先顺序的完善、对司法人员职务犯罪监检管辖的优化协调、职能管辖错位规制阙如的弥补。

The procedural jurisdiction in the investigation and handling of duty crime cases involves two levels:internal and external.The internal procedural jurisdiction mainly focuses on the supervision and investigation of oneself and its superior-subordinate relationships,while the external procedural jurisdiction focuses on the coordination and connection between the supervisory organs,public security organs,and procuratorial organs.The jurisdiction of supervision and investigation procedures starts from physical jurisdiction,with the premise of integrated investigation of duty violations and duty crimes,and must follow the rule of law operation of supervision and investigation.The existing regulatory system optimizes the functional jurisdiction rules of some external work scopes,including the transformation from one-way clue transfer to two-way clue transfer rules,the competition and interweaving of jurisdiction between supervisory and procuratorial organs,and the association and cooperation between supervisory and public security organs in cases involving each other.In addition,the investigation jurisdiction rules from the perspective of internal division of labor have been refined and improved,including adjustments to the rules of hierarchical jurisdiction and regional jurisdiction,and the implementation of the system of hierarchical jurisdiction and designated jurisdiction.There is room for further optimization of the procedural jurisdiction rules in the investigation and handling of job-related crimes,which specifically involves clarifying the language of the procedural jurisdiction in existing rules for mutual cases,improving the priority order of the procedural jurisdiction in mutual cases,optimizing and coordinating the jurisdiction of judicial personnel in the supervision and prosecution of job-related crimes,and compensating for the lack of regulation of functional jurisdiction misalignment.
