摘要
随着数据成为新的生产要素及国家基础性战略资源,数据权属问题也成为制约数据要素市场发展和国家数据治理中的重点问题。厘清各数据主体之间错综复杂的权利关系对于促进数据高效有序流动、保障数字经济持续健康发展具有重要意义。对比分析世界主要国家在数据权利归属与保护、数据开发利用的相关做法,结合国内数据权属问题研究与实践的最新进展,分析当前面临的困难挑战,提出破解我国数据权属困境的思路方法。
As data becomes a new factor of production and a fundamental national strategic resource,the issue of data ownership has also become a key issue that constrains the development of the data factor market and national data governance.Clarifying the complex rights relationships among various data subjects is of great significance for promoting efficient and orderly data flow and ensuring the sustainable and healthy development of the digital economy.This paper carries out a comparative study on the relevant practices of data ownership and protection,as well as data development and utilization in major countries around the world.Based on the latest progress in the study and practice of data ownership issues in China,it analyzes the difficulties and challenges currently faced,and proposes ideas and methods to solve the data ownership dilemma in China.
