摘要
国际上EPC、DB的主要含义是以总价合同为基础,通过总价包干或可调总价的方式,激发总承包商优化设计的动力,实现设计、采购、施工等各阶段工作的深度融合,达到降低成本、缩短工期、优化资源配置的目的。国内相关行业对EPC、DB内涵没有深入区分,特别是结算原则没有统一规定,以至于不少工程总承包项目实际上被做成了DBB,且争议很大,导致合同履行困难,履约效率下降,建立工程总承包两种模式的规则已缓不济急。文章认为国内工程总承包,应按照EPC、DB模式分别建立体系,明确各自内涵和规则,通过对比分析国际通用的两种模式的内涵,探讨了建立适合我国国情的两种模式规则,提出完善我国工程总承包管理体制的建议,有助于建立两种模式分别对应的标准合同格式。
The main meaning of EPC and DB internationally is based on a total price contract,using a lump sum or adjustable total price approach to stimulate the general contractor's motivation to optimize design,achieve deep integration of design,procurement,construction and other stages of work,and achieve the goal of reducing costs,shortening construction periods,and optimizing resource allocation.There is no in-depth distinction between the connotations of FPC and DB in domestic regulations,especially the lack of unified settlement principles.As a result,many engineering general contracting projects have actually been made into DBB,and there is a lot of controversy,leading to difficulties in contract performance and a decrease in performance efficiency.The establishment of rules for the two modes of engineering general contracting is no longer urgent.The article believes that domestic engineering general contracting should establish separate systems according to the EPC and DB models,clarify their respective connotations and rules.By comparing and analyzing the connotations of the two internationally recognized models,this article explores the establishment of rules suitable for China's national conditions and proposes suggestions for improving China's engineering general contracting management system.This will help establish standard contract formats corresponding to the two models in the future,reduce the social costs of operating the engineering general contracting model.
