安全生产行政公益诉讼起诉条件探究

Exploring the Prosecution Conditions for Administrative Public Interest Litigation in Production Safety

安全生产行政公益诉讼是当下检察机关探索的重要公益诉讼类型,也是理论界公益诉讼研究的热点。从司法实践上看,该领域公益诉讼配套法律制度仍较为薄弱,实践中安全生产行政公益诉讼的起诉条件尚存一定争议,对制度的进一步发展造成阻碍。通过文义解释、体系解释等方式,对安全生产行政公益诉讼中“安全生产”“重大事故”与“重大事故隐患”“负有监管职责的行政单位”“公共利益”以及“行政机关未依法履职”等概念的内涵和外延进行分析,厘清安全生产行政公益诉讼中检察机关受案范围、监督职责、诉讼前提以及诉讼对象等问题,进而明确安全生产行政公益诉讼起诉条件,为安全生产公益诉讼制度的实践提供助益。

Administrative public interest litigation in production safety is an important type of public interest litigation explored by the procuratorial authorities at present,and is also a hot topic for public interest litigation research in the theoretical circles.From the perspective of judicial practice,the supporting legal system for public interest litigation in this area is still relatively weak,and the prosecution conditions of administrative public interest litigation in production safety in practice are still controversial,which hinders the further development of the system.Therefore,this paper uses textual interpretation,systematic interpretation,etc.,to analyze the connotation and extension of concepts like"production safe","major accidents"and"hidden dangers for major accidents","public interest"and"the administrative organs who fail to perform their duties in accordance with the law"in the production safety administrative public interest litigation,and to clarify the scope of cases to be accepted by procuratorial organs,supervisory duties,litigation prerequisites and litigation object(s)etc.in the litigation,followed by further clarification of the prosecution conditions in the production safety administrative public interest litigation,so as to provide some reference to the practice of this system.
