中药品种保护知识产权化的理论基础

Theoretical basis of intellectual property protection of traditional Chinese medicines varieties

淡化中药品种保护制度的药品监督管理职能,强化其知识产权功能是学界期待,是中药品种保护制度的发展趋势。为厘清中药品种保护制度知识产权化的理论基础,并为后续设计中药品种知识产权保护机制提供理论根基,结合知识产权“激励论”“利益平衡论”展开了分析,发现中药品种保护制度具有创新鼓励的导向以及在企业与社会公众之间利益平衡的努力,内含上述知识产权基本理论的精髓,具备从药品监督管理制度转型为知识产权制度的理论基础。

It is the expectation of academia and the development trend of the protection system for varieties of traditional Chinese medicines(TCM)to dilute the function of drug supervision and administration and strengthen its function of intellectual property.In order to clarify the theoretical basis of intellectualization of the protection system for TCM varieties,and provide a theoretical basis for the subsequent design of the intellectual property protection mechanism of TCM varieties,this paper analyzes the“incentive theory”and“interest balance theory”of intellectual property,and finds that the protection system for varieties of TCM has the orientation of innovation encouragement and the effort of balancing interests between enterprises and the public,contains the essence of the above basic theory of intellectual property,and has the theoretical basis for transforming from the drug supervision and management system to the intellectual property system.
