论推动构建包容普惠的知识产权国际规则

Promoting the Construction of Inclusive and Balanced International Rules for Intellectual Property Rights

近年来,“推动构建包容普惠的知识产权国际规则”的表述陆续出现在我国知识产权政策文件中。在叙事话语层面,其与我国提出的《全球发展倡议》和构建人类命运共同体理念相契合。然而,知识产权专有性和法定性与“包容普惠”所强调的开放性和可及性等存在紧张的对立,知识产权的现有规则中的包容普惠条款较为零散。在国际层面,知识产权国际协调的棘轮效应对国家条约义务的约束以及体制转换造成议题切换的灵活性,使国际知识产权规则朝着普惠、包容方向发展还存在障碍。因此,我国应在多边体制中积极呼吁推动构建开放包容、平衡普惠的知识产权国际规则,并在国内规则中践行这一指导原则,修订知识产权规范。

In recent years,“promoting the construction of inclusive and bal-anced international rules of intellectual property”has appeared in China’s intellectu-al property policy documents,which is consistent with China’s Global Develop-ment Initiative and the idea of building a community with a shared future for man-kind at the narrative discourse level.Due to the tension between the exclusivity and legality of intellectual property rights and the openness and accessibility empha-sized by“inclusivity and balance”,the existing rules of intellectual property law contain scattered provisions on inclusivity and balance.At the international level,due to the ratchet effect of international coordination of intellectual property rights,which constrains national treaty obligations,and the flexibility of regime shifting caused by institutional transformation,there are obstacles in promoting the develop-ment of international intellectual property rules towards inclusiveness and balance.China should actively call for the construction of open,inclusive,balanced and af-fordable international rules on intellectual property rights in the multilateral system,and implement this guiding principle in domestic rules to revise intellectual proper-ty norms.
