论超级互联网平台治理权的行政法规制

On Administrative Law Regulation of the Governance Power of Super Internet Platforms

由于超级互联网平台治理权具有一定的权力属性,因此以遏制权力滥用为己任的行政法规制模式应当成为识别和规制超级互联网平台治理权的重要模式。具体而言,应当通过分析超级互联网平台经营者的平台治理权行使是否遵循“依规治理”“正当程序”和“比例原则”来识别是否存在滥用平台治理权行为,并运用行政法信息规制、行政指导等方式从源头上遏制滥用超级互联网平台治理权滥用行为。

Since the governance power of the super Internet platform(Gatekeepers)has certain power attributes,the administrative law regulation mode which aimed to curb the abuse of power should become an important mode for identifying and regulating the governance power of the super Internet platform.Specifically,it is necessary to identify whether the abuse of platform governance powers by analyzing whether the super Internet platform operators'exercise of platform governance powers follows the“rule based governance”,“due process”and“proportionality principle”,and curb the abuse of super Internet platform governance powers through information regulation and other regulatory tools from the beginning.
