Scientifically Constructing a Theoretical System of Cultural Law with Chinese Characteristics under the Guidance of Xi Jinping's Thought on the Rule of Law and Xi Jinping's Thought on the Culture

文化法学是以文化法现象为研究对象的一门法学学科。文化法学因为研究对象所规范的社会关系具有高度意识形态性而必须明确自身的研究目的和方法。其中,习近平法治思想和习近平文化思想可以为文化法学的学科体系、学术体系和话语体系建设提供科学和有效的理论方向的指引。构建中国特色文化法学理论体系,应当秉持“大文化”的概念,即文化法调整的社会关系应当是物质、制度和意识形态三个层面的文化现象。与此相对应地,文化法学的理论体系也应当建立在广义的文化法律制度基础之上,既包括调整文物、文化财产等物质形态的法律制度,也包括规范非物质文化遗产、民间规范、爱国主义教育等精神形态的法律制度。文化法学的知识体系要注重自身的实践特征,特别是要对文化法治的要素和运行机制进行科学研究,以习近平法治思想为指导,坚持党的领导和以人民为中心的原则;以习近平文化思想为指导,将“两个结合”的价值要求渗透到文化法学的学术体系中,采用文化法学研究的历史与现实相贯通的研究方法,全面、系统和科学地阐述中国特色社会主义文化事业发展规范化、制度化和法律化的特征,揭示社会主义文化法治建设的内在规律,提升文化法学理论在指导文化法治实践中的理论指导功能,并通过正确处理文化法学与文化学、艺术学等相关学科的关系,确保文化法学作为法学新兴学科的学科独立性和学术话语权。

Cultural law is a legal discipline that focuses on the phenomenon of cultural law as its research object.Culture law must clarify its own research purposes and methods because of the highly ideological social relations which is regulated by the research object.Among them,Xi Jinping's Thought on the Rule of Law and Xi Jinping's Thought on the Culture can provide scientific and effective theoretical guidance for the construction of the disciplinary system,academic system,and discourse system of cultural law.To construct a theoretical system of cultural law with Chinese characteristics,the concept of"big culture"should be upheld,which means that the cultural and social relationships adjusted by cultural law should be cultural phenomena at three levels:material,institutional,and ideological.Correspondingly,the theoretical system of cultural law should also be established on the basis of a broad cultural legal system,including the legal system for adjusting material forms such as cultural relics and cultural property,as well as the legal system for regulating intangible cultural heritage,folk norms,patriotic education,and other spiritual forms.The knowledge system of cultural law should focus on its own practical characteristics,especially scientific research on the elements and operating mechanisms of cultural rule of law,guided by Xi Jinping's Thought on the Rule of Law,adhering to the leadership of the Party and the principle of putting the people at the center;adhere to the guidance of Xi Jinping's Thought on the Culture,integrate the value requirements of"two combinations"into the academic system of cultural law,adopt a research method that connects the history and reality of cultural law research,comprehensively,systematically and scientifically explains the characteristics of the standardization,institutionalization,and legalization of the development of socialist cultural cause with Chinese characteristics,reveals the internal laws of socialist cultural rule of law construction,enhances the theoretical guidance function of cultural law theory in guiding the practice of culture and the rule of law,and ensures the independence and academic discourse power of cultural law as an emerging discipline of law by correctly handling the relationship between cultural law and related disciplines such as cultural science and art.
