Rethinking the Normativity of Contemporary Global Order from the Perspective of Rainer Forst

规范性是社会秩序的基本道德要素,而适用于正当秩序最重要的规范性概念就是正义。面对当前全球秩序的规范性面临诸多挑战,传统的正义观念已经无法满足当前世界多元发展的规范诉求,如何化解多元文化的发展与统一规范的正义秩序之间的紧张关系成为政治哲学探讨的核心焦点。这种世界秩序的范式转换已然不仅是一个社会合法的规范性问题的解决方式,更是世界各民族共同追求的解放要求。本文立足于弗斯特“证成权利”这一核心主线阐述弗斯特如何协调个人、国家以及世界之间的权利关系,从而为缓和世界多元发展与统一的正义规范秩序要求之间的紧张关系提供理论与实践的方案。

Normativity is the basic moral element of social order,and the most important normative concept applicable to proper order is justice.In the face of many challenges to the standardization of the current global order,the traditional concept of justice has been unable to solve the normative demands of the diversified development of the current world.How to resolve the tension between the development of multiculturalism and the unified and normative order of justice has become the core focus of political philosophy.This paradigm shift of world order is not only a normative issue of social legality,but also the liberation requirement pursued by all nations in the world.Based on the core line of“the right to justification”,this paper expounds how Forst harmonizes the relationship of rights among individuals,countries and the world,so as to provide theoretical and practical basis for solving the tension between the pluralistic development of the world and the requirements of uniform justice and normative order.
