On the Implementation of the Legal System of Network Information Security Supervision

网络安全事关整体的发展与安全,出于现实与长远的需求,网络信息安全监管法治体系的理论研究应时、应需、应势、应责,基于执法主体的视角,从法学领域中走出传统的学科范式,面向实践与实战,坚持开放交叉、融通、协作、多学科共同协同研究的路径。网络安全关乎国家安全、社会安全、公共安全,主要可以分为网络运行安全、网络信息安全和数据安全三大领域。网络信息安全监管法治体系中的运行路径包括规制路径、管制路径、自治路径、智治路径。应从监管实践现状角度切入,设计监管实施路径、监管法治监督体系、监管法治保障体系。

Network security is related to the overall development and security.For the practical and long-term needs,the theoretical research on the rule of law system of network information security supervision shall respond to time,demand,situation and responsibility.Based on the perspective of the subject of law enforcement,we shall get out of the traditional discipline paradigm in the field of law,face practice and actual combat,and adhere to the path of open intersection,integration,cooperation and multi-disciplinary collaborative research.Network security is related to national security,social security and public security,which can be divided into three areas:network operation security,network information security and data security.The operation path in the legal system of network information security supervision includes regulation path,control path,autonomy path and intellectual governance path.From the perspective of the current situation of supervision practice,we shall design the implementation path of supervision,the supervision system of the rule of law and the guarantee system of the rule of law.
