论NFT数字藏品平台的责任分级承担制度

On the Responsibility Grading and Sharing System of NFT Digital Collectible Platforms

和传统互联网平台一样,NFT平台之间也存在着巨大差异,故而在规范平台责任时,应当建立责任分级承担制度而非“一刀切”。近年来,我国已针对互联网平台分级出台了《分类分级指南》《主体责任指南》等文件,但是由于其无法直接适用于NFT平台中,故急需建立针对该领域的新的分级制度。此外,责任分级承担制度的构建有益于NFT数字藏品的健康发展、消费者权益保护和著作权人权益保护。根据欧盟《数字服务法案》以及我国《分类分级指南》《主体责任指南》的相关规定,可从用户规模、市值以及技术能力这三个方面出发规定NFT平台责任分级承担的具体规则。

Just like traditional internet platforms,there are significant differences between NFT platforms.Therefore,when regulating platform responsibilities,a responsibility grading and sharing system should be established instead of a"one-size-fits-all"approach.In recent years,China has issued documents such as the"Classification and Rating Guidelines"and the"Main Responsibility Guidelines"for internet platforms.However,these cannot be directly applied to NFT platforms,so there is an urgent need to establish a new grading system specifically for this field.Furthermore,the construction of a responsibility grading and sharing system is beneficial for the healthy development of NFT digital collectibles,protection of consumer rights,and protection of copyright holders'rights.Based on the provisions of the EU's"Digital Services Act"and China's"Classification and Rating Guidelines"and"Main Responsibility Guidelines,"specific rules for the responsibility grading and sharing of NFT platforms can be determined from three aspects:user base,market value,and technical capabilities.
