对涉人体冷冻胚胎案之司法审判的再审视--基于2014年至2023年52例类案的实证分析

Judicial Review of the Right on Frozen Human Embryos--Based on the 52 Similar Cases from 2014 to 2023

分析2014年至2023年的52件涉及人体胚胎纠纷的司法审判案,发现其审判结论差异很大;究其原因,则是冷冻胚胎属性认定不清、差异判决所导致的请求权的混乱选择以及法律适用不一,为预防医与法的冲突,应明确人体胚胎之人格物的法律属性,并以《民法典》人格权为基础完善冷冻胚胎利用的配套法律制度,及医疗机构的格式文本。

In this paper,based on the analysis of 52 cases involving human embryo disputes from 2014 to 2023,it is found that their trial conclusions varied greatly.And the reasons are unclear identification of the attributes of frozen embryos,the confused choice of claims caused by different judgments and the different application of laws.In order to prevent the conflict between medicine and law,the legal attributes of the personality of human embryos should be clarified,and the supporting legal system of frozen embryos utilization and the format text of medical institutions should be improved based on the personality rights of The Civil Code.
