从历史档案看宋朝官吏管理的法文化——以《武义南宋徐谓礼文书》为切入点

The Legal Culture of the Management of Officials in Song Dynasty from Historical Archives--A Case Study of Documents of Xu Weili from Wuyi in Southern Song Dynasty

对官员的考察是职官法内容的重要部分,可以使官员在任期间行为得到国家强制性约束。由于磨勘法的盛行,宋廷对官员的考察多以批书印纸的方式体现和进行,故而在《武义南宋徐谓礼文书》中所呈现出的与徐谓礼相关的考课内容,多以批书印纸的方式保存了下来,这些录白印纸反映了南宋中后期中下层职官的考课经历。以《武义南宋徐谓礼文书》为研究切入点,对比由北宋至南宋职官考课法的变迁,以此分析两宋不同时期对职官要求的不同侧重,以期为当下依法治官、从严治官提供历史经验。

The assessment of officials is an important part of the content of the official law,which can subject the behavior of officials during their tenure to mandatory state constraints.Due to the prevalence of the Mokan method,the Song court’s assessment of officials was mostly reflected and conducted through the method of approving and stamping documents.Therefore,the assessment content related to Xu Weili presented in the Wuyi Southern Song Xu Weili’s Documents was preserved in the form of approved and stamped documents.In these recorded white-stamped documents,the assessment experiences of middle and lower-level officials in the middle and late Southern Song Dynasty are reflected.By taking the Wuyi Southern Song Xu Weili’s Documents as a research entry point,this paper compares the changes in the official assessment laws from the Northern to the Southern Song Dynasty,analyzing the different emphases on official requirements in different periods of the two Song Dynasties,aiming to provide historical experience for the current strict governance of officials and legal governance of officials.
