网络直播著作权侵权问题研究

Research on Copyright Infringement in Online Live Streaming

随着互联网的高速发展,娱乐方式发生巨大变化,网红通过直播,微博,小红书,抖音短视频等多渠道直播成为一大热潮,但是伴随着直播的火热的同时却隐含著作权侵权、隐私权侵权、维权难等法律问题,对现有经济健康发展存在隐患,而这里面网络直播侵权问题尤甚。本文先论述网络直播的相关理论,定义,特点,以及网络直播的产生和类型,以此为后文论述奠定理论基础。再讲述网络主播的直播画面是否应该属于《著作权法》中的“作品”。作品的构成是必须符合独创性、新颖性的文学艺术领域内的作品,直播内容的判断性质有待考究。网络直播中的著作权侵权与一般民事侵权有类似的地方,也有不同的地方。一般的民事侵权采用过错原则追究法律责任,这往往是发生在双方之间的法律关系,在网络直播中著作权纠纷当中,网络平台又该如何判断,在学界还未形成统一意见。

With the rapid development of the Internet,great changes have taken place in the way of entertainment.Online celebrities have become a major craze through live broadcast,microblog,Xiaohongshu,Tiktok short video and other channels.However,with the popularity of live broadcast,there are hidden legal issues such as copyright infringement,privacy infringement,and difficulty in safeguarding rights,which pose a hidden danger to the healthy development of the existing economy,especially online live broadcast infringement.This article first discusses the relevant theories,definitions,characteristics,as well as the emergence and types of online live streaming,laying a theoretical foundation for the subsequent discussion.Further discussion on whether the live broadcast footage of online anchors should belong to the category of“works”in the Copyright Law.The composition of works must conform to the originality and novelty of literary and artistic works,and the nature of the judgment of live broadcast content needs to be studied.There are similarities and differences between copyright infringement in online live streaming and general civil infringement.The general civil infringement adopts the principle of fault to pursue legal responsibility,which often occurs in the legal relationship between the two parties.In copyright disputes in online live streaming,how should online platforms judge has not yet formed a unified opinion in academia.
