长三角一体化背景下数字经济协同立法研究

Research on Collaborative Legislation for Digital Economy in the Context of Yangtze River Delta Integration

数字经济发展需要立法为其提供法治保障,中央有关数字经济立法缺位的情况下,地方立法可以发挥先行作用。数字经济具有跨部门、跨区域、跨层级的特点,长三角一体化的重大战略需要加强区域间协作治理,目前长三角数字经济立法呈现出数字经济发展存在区域壁垒、地区发展差异削弱立法协同性、数字经济立法体系化不足等问题。长三角数字经济协同立法具有宪法、法律、政策层面的规范基础,以及经验与需求层面的实践基础,因此以协同立法促进数字经济发展具有可行性。应当从内容层面与机制层面对数字经济协同立法进行路径构建,通过提升协同立法内容要素合理性、加强区域间立法协调合作、完善协同立法保障机制助力实现长三角数字经济稳步安全发展。

The development of digital economy needs legislation to provide rule of law protection for it,and in the absence of central legislation on digital economy,local legislation can play a pioneering role.Digital economy has cross-sectoral,cross-regional,cross-level characteristics,the Yangtze River Delta integration of major strategies need to strengthen inter-regional collaborative governance,the current digital economy legislation in the Yangtze River Delta digital economy there are re-gional barriers to the development of the digital economy,regional development differences wea-ken the synergies of the legislation,the digital economy legislation is insufficient systematization of the problems.The collaborative legislation on digital economy in the Yangtze River Delta has a normative basis at the constitutional,legal and policy levels,as well as a practical basis at the ex-perience and demand levels,so it is feasible to promote the development of digital economy through collaborative legislation.The path of collaborative legislation on digital economy should be constructed from the content level and mechanism level,and the steady and safe development of digital economy should be realized by improving the rationality of the content elements of col-laborative legislation,strengthening the coordination and cooperation of inter-regional legisla-tion,and perfecting the guarantee mechanism of collaborative legislation.
