Digital Prosecution Boosts Procuratorial Suggestions to Improve Quality and Efficiency

数字检察、检察建议都是检察机关履行法律监督职责的重要手段,2021年中共中央发布了《关于加强新时代检察机关法律监督工作的意见》,其中既着重强调了检察建议的重要作用,同时提出检察机关要以大数据、区块链技术提升法律监督工作能力。作为数字检察的试点,浙江检察已经在数字检察和检察建议相结合上取得了良好的效果,但综合全国来看,仍然可能面临着数据单一、政府部门参与建设的积极性不高以及数据安全等发展困境。本文采用了文献研究法、个案分析法,对数字检察助推检察建议的优势进行了分析,提出了二者相结合过程中可能遇到的问题,并分析了相关原因。有鉴于此,提出如下对策,包括形成以党委为领导,政府为主导的工作机制、推广优秀法律监督模型、适时制发检察建议助力数据获取、出台司法解释保障数据安全。

Digital prosecution and procuratorial suggestions are important means for procuratorial organs to perform their legal supervision duties.In 2021,the Central Committee of the Communist Party of China issued Opinions on Strengthening Legal Supervision of Procuratorial Organs in the New Era,which not only emphasized the important role of procuratorial suggestions,but also proposed that procuratorial organs should improve their legal supervision ability with big data and block-chain technology.As a pilot project of digital procuratorial work,Zhejiang procuratorial work has achieved good results in the combination of digital procuratorial work and procuratorial sugges-tions,but overall,it may still face development difficulties such as single data,low enthusiasm of government departments to participate in construction and data security.In this paper,literature research and case analysis are used to analyze the advantages of digital prosecution to boost procuratorial suggestions,put forward the problems that may be encountered in the process of combining the two,and analyze the relevant reasons.In view of this,the following strategies are put forward,including the formation of a working mechanism led by the Party Committee and the government,the promotion of excellent legal supervision models,the timely issuance of procura-torial suggestions to help data acquisition,and the introduction of judicial interpretations to en-sure data security.
