优化营商环境背景下基层法治政府建设的检察路径研究

Study on the Prosecutorial Path of Rule of Law-Based Government Construction at the Basic Level in the Context of Optimizing the Business Environment

在优化营商环境的社会背景之下,营商环境和法治政府具有内在一致性,而基层政府是法治政府建设中最关键的环节,直接贯彻执行国家法律,联系着社会公共利益和公民个人利益。通过十八届三中全会以来的实践来观察,基层政府在自我法治建设方面仍然存在不足,其中的原因包括形式法治和实质人治并存、部分领导干部缺乏法治思维以及行政监督力量相对较弱等。通过检察机关发挥其法律监督者的职能,可与政府依法行政产生相互作用,进而实现通过检察机关发挥职能来促进基层法治政府建设,进而作用于营商环境优化建设。检察机关可以在主动履行职能、增加主动参与式监督;充分发挥行政公益诉讼职能和推广合规检察机制,实现积极参与基层政府法治建设,促进优化营商环境发展的目的。

In the social context of optimising the business environment,there is an inherent consistency be-tween the business environment and the law-based government,and the primary-level govern-ment is the most crucial link in the construction of the law-based government,which directly car-ries out the implementation of the national laws,and connects the public interests of the society with the interests of the individual citizens.Through the practice since the Third Plenary Session of the 18th Central Committee of the Communist Party of China(CPC),the primary-level govern-ment is still deficient in self-rule of law construction,which is due to the co-existence of the formal rule of law and the substantive rule of man,the lack of rule of law thinking of some leading cadres,and the relatively weak power of administrative supervision.Through the procuratorate’s function as a legal supervisor,it can interact with the government’s administration in accordance with the law,thereby promoting the construction of primary-level rule of law-based government through the function of the procuratorate,which in turn contributes to the optimisation of the business envi-ronment.Procuratorial organs can take the initiative to perform their functions,increase active participatory supervision;give full play to the function of administrative public interest litigation and promote the mechanism of compliance prosecution to achieve the purpose of actively partic-ipating in the construction of the rule of law at the grass-roots level of government,and promoting the development of optimised business environment.
