摘要
“造成恶劣社会影响”是司法工作人员渎职犯罪中的一个重要的量刑标准。司法实践中造成非物质性损害后果的渎职行为通常适用该项标准定罪量刑。当前的司法解释对于“恶劣社会影响”并无具体认定标准,实践中经常会出现两种极端的情况,一是对于“恶劣社会影响”的认定过于宽泛,近乎把“恶劣社会影响”等同于“非物质损失”。与之相对应的,则是对“恶劣社会影响”不敢适用,认为“恶劣社会影响”有“舆论审批”之嫌,违背法治精神。本文从司法工作人员渎职犯罪“恶劣社会影响”司法适用不当的原因出发,结合办理的具体案例,分析“恶劣社会影响”的合理内涵,确立认定造成“恶劣社会影响”的基本原则和认定方法,从科学界定“造成恶劣社会影响”的合理内涵、明确认定“造成恶劣社会影响”的基本原则和建立科学的司法认定方法等三个方面对“造成恶劣社会影响”提出相应的适用建议,为办好司法工作人员渎职犯罪案件做出一定的贡献。
“Causing bad social influence”is an important sentencing standard in the crime of judicial mal-feasance.In judicial practice,the standard is usually applied to the dereliction of duty resulting in non-material damage.There are two extreme in the current judicial interpretation of“bad social influence”,one is that the definition of“bad social influence”is too wide,it almost equates“bad social influence”with“non-material losses”.In contrast,it does not dare to apply to“bad social in-fluence”,and considers that“bad social influence”has the suspicion of“public opinion examina-tion and approval”,which is against the spirit of the rule of law.Based on the reason of improper judicial application of the crime of malfeasance of judicial staff,this paper analyzes the reasonable connotation of“bad social influence”,to establish the basic principles and methods of“bad social influence”,to put forward corresponding suggestions on“causing bad social influence”from three aspects:scientifically defining the reasonable connotation of“causing bad social influence”,clearly identifying the basic principles of“causing bad social influence”and establishing scientific judicial determination methods,and make a certain contribution to handling the cases of judicial person-nel dereliction of duty.
