台湾地区对“反渗透法”的司法援引、适用及其影响

Judicial Citation and Application of"Anti-Infiltration Act"and Its Impact in Taiwan region

台湾地区强力通过的“反渗透法”已成为民进党当局全面阻碍两岸民间交流、恐吓台湾地区民众及打压选举竞争对手的“法律工具”,对“反渗透法”的司法援引与适用也成为民进党当局制造“执政优势”“寒蝉效应”和“绿色恐怖”的重要手段。相关案例大致可以分为涉案自然人引用、“法院”参考援引、“法院”裁定援引、“法院”判决适用等4种类型,司法裁判对“反渗透法”的援引和适用既是对条文空白授权及执行机关自由裁量权的认可,也体现了类推适用和扩张解释的逻辑。司法裁判将“受内地资助、委托或指示”作为违反“反渗透法”的构成要件,但又无视当事人主观意图和行为的客观效果,缺乏关于“实质控制力”的证据与论证。台湾地区对“反渗透法”的援引与适用违背法治原则、侵害人权自由,对两岸融合发展氛围、岛内民主机制运行环境和政治文化生态演进,以及台湾地区民众正当利益表达等都产生了消极影响。

"Anti-Infiltration Act"forcefully passed in Taiwan has become"a legal tool"for the Democratic Progressive Party authorities to comprehensively hinder cross-Strait civil exchanges,intimidate Taiwan residents,and suppress electoral competitors.The judicial citation and application of"Anti-Infiltration Act"has also become an important means for the DPP authorities to create ruling advantages,chilling effects and Green terror.Relevant cases can be roughly divided into four types:citation by persons concerned in the case,reference citation by courts,citation by court rulings,and application by court adjudications.The citation and application of"Anti-Infiltration Act"in judicial judgments is not only a recognition of the authorization of blank provisions and the discretionary power of the executive agency,but also reflects the logic of analogical application and expanded interpretation.Judicial judgments regard"being funded,commissioned or instructed by the China's mainland"as a constituent element of violating"Anti-Infiltration Act",but ignore the subjective intentions of the parties and the objective effects of their actions,which lacks evidence and argumentation on substantial control.The citation and application of"Anti-Infiltration Act"in Taiwan violates the rule of law and infringes upon human rights and freedoms.It has had a negative impact on the atmosphere of cross-Strait integration and development,the operating environment of democratic mechanisms on the island,the evolution of the political and cultural ecology,and the expression of the legitimate interests of Taiwan compatriots.
