社会治理视域下我国轻罪治理的目标、要求及实现路径

The Objectives,Requirements,and Implementation Paths of Misdemeanor Governance:A Perspective of Social Governance

从2013年开始,我国犯罪现象内部结构出现显著变化,呈现“双降双升”的特点,我国进入轻罪时代。犯罪治理是法治现代化和国家治理的重要内容,轻罪治理是提升社会治理法治化水平的重要着力点。轻罪治理的最终目标是建设更高水平的平安中国;轻罪治理必须紧紧围绕这个目标,科学控制犯罪,这要求轻罪治理必须始终坚持党委领导,构建高效的政府负责体制,充分发挥民主协商、社会协同、公众参与的重要作用,依赖法治保障,借力科技支撑;轻罪治理体系结构上包括“谁来治理”和“如何治理”,空间上涵盖法的实现全过程,即轻罪立法、轻罪司法、轻罪执法、全民守法,各阶段的治理主体相互配合,形成轻罪治理共同体,保障轻罪治理目标达成。

Since 2013,there have been significant changes in the internal structure of the crime phenomenon in China,characterized by a“double-decrease and double-rise”trend,and China has entered the era of misdemeanors.The governance of crime is an important element of the modernization of the rule of law and national governance,and the misdemeanor governance is an important focus for enhancing the level of social governance under the rule of law.The misdemeanor governance must closely focus on this goal and scientifically control crime,which requires that the misdemeanor governance must always adhere to the leadership of the Party,build an efficient government responsibility system,give full play to the important role of democratic consultation,social coordination and public participation,rely on the guarantee of the rule of law,and rely on scientific and technological support.The structure of the misdemeanor governance system includes“who governs”and“how to govern”,and spatially covers the entire process of realizing the law,i.e.,misdemeanor legislation,misdemeanor justice,misdemeanor law enforcement,and law-abiding by all people,with the main bodies of the governance of the various phases cooperating with each other to form a community of misdemeanor governance and to safeguard the achievement of the goals of misdemeanor governance.
