行政违法行为检察监督的若干思考

Reflections on the Procuratorial Supervision over Administrative Illegal Activities

党的十八届四中全会部署的改革任务之一是检察机关积极探索开展行政违法行为监督,行政违法行为检察监督是提升国家治理能力的重要方式,也是完善国家治理体系不可或缺的组成部分。目前,我国关于行政违法行为检察监督的理论研究与实践基础较少,尤其是理论研究部分尚存空白。基于此,文章以我国宪法对检察机关法律监督机关的属性定位为契入点,针对行政违法行为检察监督的内涵、依据以及原则展开全面论证分析,并结合当前行政违法行为检察监督工作开展的实际情况,全面总结行政违法行为检察监督的实践经验,重点找出实践中的问题与不足之处进行深入剖析,围绕监督刚性、问题发现机制、监督工作发展、监督范围、监督能力、监督质效等多个方面展开论述,并有针对性地提出相应的建议。

One of the reform tasks deployed by the Fourth Plenary Session of the 18th CPC Central Committee is that the procuratorial organs actively explore the supervision of administrative illegal acts.Procuratorial supervision of administrative illegal acts is an important way to enhance the national governance capacity,and it is also an indispensable and extremely important part of improving the national governance system.At present,there is little theoretical research and practical basis for the procuratorial supervision of illegal acts in our country,especially there is still a gap in the theoretical research.Based on this,the connotation,basis and principle of the procuratorial supervision of administrative illegal acts are comprehensively demonstrated and analyzed by taking the attribute of the procuratorial organ to the legal supervision organ in our Constitution as the entry point.Combined with the actual situation of the current procuratorial supervision of administrative illegal acts,it comprehensively summarizes the practical experience of the procuratorial supervision of administrative illegal acts,focuses on identifying the problems and shortcomings in its practice for in-depth analysis,and discusses the rigidity of supervision,problem discovery mechanism,supervision work development,supervision scope,supervision ability,supervision quality and efficiency.And the corresponding suggestions are put forward accordingly.
