社会组织参与社会法治治理的梗阻因素与实现路径——枫桥经验下的“第三种活法”

Obstacles and implementation paths of social organizations’participationin social governance under the rule of law:“the third type ofliving law”guided by the Fengqiao experience

社会组织参与社会法治治理主要面临发展空间狭窄、内生动力不足两大梗阻因素。枫桥经验中社会组织自愿、自发、自主参与社会法治治理的安排契合了现代社会法治治理的需求,积极参与社会法治治理的各种类型的社会组织已成为新时代枫桥经验变革创新、服务社会的最重要载体,成为社会治理的“第三种活法”。社会组织参与社会法治治理在与新时代枫桥经验的结合中形成从自发到认可、从规定到实践、从框架到机理的三大路径,是社会法治治理水平和能力显著提升的实践论成果,体现为治理共同体下法治信仰和法治文化的认识论结晶。进一步巩固、优化这一成果,疏通社会组织参与社会法治治理的痛点、堵点、难点,实现社会组织有效参与社会治理和多元治理主体的同频共振,应在枫桥经验指引下支持、引导、鼓励社会组织聚焦基层治理、激活内生动力,拓宽其发展与活动的法律空间。

Social organizations participating in social governance through the rule of law are mainly faced with two major obstacles:limited development space and insufficient endogenous power.The experience of Fengqiao demonstrates that the voluntary,spontaneous,and autonomous participation of social organizations in social governance aligns with the needs of modern society’s rule of law.Various types of social organizations actively engaging in social governance have become the most crucial carriers for innovation and transformation under the new era’s Fengqiao experience,embodying a“the third type of living law”of social governance.Social organizations participating in social governance by law have formed three major paths:from voluntary to recognized,from regulation to practice,and from framework to mechanism,which represent practical achievements in improving the level and capacity of social governance under the belief and culture of the rule of law within governance communities.Further consolidation and optimization of these achievements involve addressing the pain points,bottlenecks,and challenges faced by social organizations in participating effectively in social governance,achieving resonance among diverse governance subjects.Guided by the Fengqiao experience,efforts should be made to support,guide,and encourage social organizations to focus on grassroots governance,activate endogenous power,and broaden the legal space for their development and activities.
