摘要
针对当前事业单位人事争议解决在法律适用上横跨多个部门法,存在认定偏差、程序混乱、同案异判等问题;认为人事争议解决中法律适用混乱、相关法缺失、行政思维冲击等是造成问题的主要原因;建议按照事业单位的分类及性质,对人事争议解决的原理进行修正;对其法律适用进行分层调整,加快构建事业单位人事争议解决的多元机制,提高争议解决的质量与效率。
In the current legal application for resolving personnel disputes within public institutions,there are issues such as identification deviations,procedural confusion,and inconsistent judgments in similar cases due to the involvement of multiple branches of law.The main causes identified include confusion in legal application,lack of relevant laws,and the impact of administrative thinking.This paper suggests revising the principles for resolving personnel disputes based on the classification and nature of public institutions,implementing hierarchical adjustments to legal applications.Furthermore,efforts should be accelerated to establish a diversified mechanism for resolving personnel disputes in public institutions,enhancing the quality and efficiency of dispute resolution.
