情理法协同共治——农村滥办酒席的应对之道

Emotional,Rational and Legal Governance of Excessive Rural Banquets

近些年来,我国局部地区尤其是农村出现了滥办酒席问题,对当地经济、社会、文化等造成了不良影响。农村滥办酒席是由于情、礼、利三重因素异化交织而成,只有通过情理法相结合的方式治理,才可能找到最佳出路。从法治角度而言,现有治理体系必须正视软法的局限,应当通过立法规范与软法引导的方式完善治理体系。从情理角度而言,对异化的情理应考虑重塑理念与更新规则的方式予以调适。与此同时,需要采取协同治理与加强监督的举措为长期治理提质,进而实现对滥办酒席问题的根治。

In recent years,the problem of excessive banquets has emerged in some parts of China,especially in rural areas,which has had harmful effect on the local economy,society and culture.The excessive banquets in rural areas are the result of the alienation and interweaving of the three factors of love,etiquette and profit,and the best way out can only be found through the combination of emotional,rational and legal governance.From the perspective of the rule of law,the existing governance system must face up to the limitations of soft law,and should improve the governance system through legislative regulation and soft law guidance.From the perspective of rationality,the alienated rationality should be adjusted by reshaping the concept and updating the rules.At the same time,it is necessary to adopt coordinated governance and strengthen supervision to improve the quality of long-term governance,thus realizing the resolution of the problem of excessive banquets.
